Clerical Error Delays Effort To Overturn Mass. Vape Ban

BOSTON (WBZ NewsRadio) — A hearing to overturn Massachusetts’ ban on the sale of vaping products was delayed because of a clerical error.

Opponents of the ban were supposed to make their case on Tuesday, but a mistake by the attorney representing six vaping companies has delayed that process.

The attorney apparently failed to file the paperwork in the right way.

If not for this error, the judge could have temporarily lifted the ban until the federal lawsuits filed against the state are resolved. But now, the ban will remain in effect.

The attorney will have to now have to file an amended complaint by Friday, and then the state will get to respond.

Vape store owners have argued that the four-month ban, imposed by Gov. Charlie Baker, is destroying their multi-million dollar industry.

Meanwhile, public health officials are reporting more cases of vaping-related lung illnesses in Massachusetts, according to the Associated Press.

Ten more cases were confirmed, making a total of 29 vaping-related lung illnesses in the state.

One woman in Massachusetts has reportedly died in connection to e-cigarette use.
