Are Voting Booth Selfies Legal In Massachusetts?

BOSTON (WBZ NewsRadio) — As early voting continues in Massachusetts, officials are warning voters to be careful they don't do something that could get them in trouble in the voting booth; taking a selfie.

Even though the "I Voted" sticker might not be enough, and voters may want to show people exactly who they voted for, Secretary of the Commonwealth Bill Galvin said it is technically illegal to take ballot selfies.

"There is a state statute on it," Galvin said. "But there have been other states that have had statutes that have had it challenged as unconstitutional because they limit peoples' freedom of expression."

In other words; it's not allowed in Massachusetts, but if you took it to court, you might win. Regardless, Galvin said officials are expecting a huge turnout for this election, and selfies in the voting booth just hold up the line.

"We've a lot of activity going on, a lot of other citizens want to get in and get out," he said. "If you're that proud of who you voted for, you can tell people how you voted, you don't have to prove it."
